Idaho Abortion Ban Challenge From Doctor Cleared to Move Forward

An Idaho obstetrician-gynecologist mostly can proceed with a lawsuit challenging the constitutionality of Idaho’s abortion bans.

Physician Stacy Seyb sufficiently alleged that the two statutes are unconstitutional because they interfere with his ability to provide abortions to patients when medically indicated, such as when the life, health, or mental health of the patient is in danger, the US District Court for the District of Idaho said Monday. The case, however, will proceed only against the prosecutor in the county where Seyb practices, Judge B. Lynn Winmill said.
