Humana Seeks Ruling That Medicare Clawback Plan Violates Law

Attorneys for Humana Inc. on Monday asked a federal district judge in Texas to grant summary judgment in their lawsuit to block a policy that would allow the US Department of Health and Human Services to claw back billions of dollars in payments to the insurer and other private Medicare Advantage plans.

The motion for summary judgment, filed with Judge Reed O’Connor of the US District Court for the Northern District of Texas, also seeks to vacate the 2023 rule that sets out how the government will determine whether Medicare Advantage plans were paid more than they should have been. ...
