Two hospitals that don’t allow abortions to be performed are under investigation by the Department of Health and Human Services over possible violations of federal law after they allegedly failed to provide stabilizing care to a pregnant woman whose medical emergency may have required treatment that could be considered an abortion.
The woman survived, but HHS Secretary Xavier Becerra is advising US hospitals that participate in Medicare that the federal Emergency Medical Treatment and Labor Act requires them to stabilize pregnant patients experiencing a miscarriage or other medical emergency, regardless of state laws—or hospital policies—that could conflict with treatment.
