Hospital Properly Terminated Staff Privileges Of Doctor Found to Have Lied on Application

A California appeals court Oct. 1 refused to issue a writ of mandate compelling a hospital to reinstate the medical staff membership and clinical privileges of a physician terminated after it was determined that he had provided incomplete and false information on his employment application (Dutta v. USC/Norris Cancer Hospital, Cal. Ct. App., B231140, 10/1/12).

The California Court of Appeal, Second District, found in an unpublished opinion that defendant USC/Norris Cancer Hospital provided Dr. Suresh Dutta with fair procedures required by the hospital’s medical staff bylaws and that termination was a proper remedy in this case.
