Hospital Group Moves to Join Suit Over J&J Drug Rebate Model (1)

A hospital group is seeking to intervene in a legal battle between Johnson & Johnson and the US government over the manufacturer’s proposal to discount drugs as a rebate under the 340B Drug Pricing Program.

340B Health and two of its hospital members are asking the US District Court for the District of Columbia to allow them to join a lawsuit between Johnson & Johnson and the US Health Resources and Services Administration to “defend the federal government’s authority to block J&J from imposing these rebates on any 340B hospitals.”
