Medical providers accused of refusing to properly treat a patient based on his inability to walk or talk are seeking a second chance to convince a federal appeals court they shouldn’t have to face disability bias claims.
St. David’s Healthcare Partnership LP and physician Viet Vo filed separate petitions Wednesday for a rehearing by the full US Court of Appeals for the Fifth Circuit. A three-judge panel departed from established law by reviving claims made by the man’s family disputing their treatment decisions, they said.
