Horizon Members Can’t Sue Insurer for Injury Allegedly Caused by Data Breach, Court Says

A federal court in New Jersey shut down a lawsuit against a health insurer that stemmed from the 2013 theft of two laptops containing its members’ private medical information (In re Horizon Healthcare Servs. Inc. Data Breach Litig., 2015 BL 90017, D.N.J., 2:13-cv-07418-CCC-JBC, 3/31/15).

The U.S. District Court for the District of New Jersey dismissed March 31 the action alleging that members of Horizon Healthcare Services Inc. were at risk of identity theft due to the data breach.
