Home Health Company Sues Over Recoupment of Medicare Payments

A Florida home health company is suing the Department of Health and Human Services, alleging the agency unlawfully recouped millions in Medicare payments through inaccurate sampling and extrapolation methods.

The complaint, filed this week in the US District Court for the Middle District of Florida, alleges that Lakeland-based Infinity Home Care was subjected to a repayment demand of $34 million after a contractor’s review and denial of 72 of Infinity’s Medicare claims was extrapolated over the full universe of claims made by the company between Jan. 2, 2014, and Sept. 13, 2016.
