The U.S. Supreme Court refused to hear a legal challenge to the Ohio Medicaid Department’s attempt to claw back $12 million in reimbursements from Cincinnati-based Carrington Health Systems.
The Ohio Medicaid Department wrongly interpreted a federal regulation in disallowing reimbursement for payments to two vendors as part of the system’s Medicaid cost reports, CHS said in its petition for review.
The state court of appeals that upheld the disallowance gave too much deference to the department’s interpretation of the regulation, and incorrectly ignored the contrary interpretation of a retired federal official who wrote the regulation, it said.
