HHS Hit With Third Suit Over Medicare Advantage Marketing Curbs

A third lawsuit challenging a federal rule that limits compensation for insurance agents, brokers, and field marketing organizations that help enroll Medicare beneficiaries was filed in a federal court in Florida.

The suit was brought by AmeriLife Holdings LLC, of Clearwater, Fla., and its subsidiary field marketing organizations, AmeriLife Marketing Group LLC and Network Insurance Senior Health Division ALG LLC. AmeriLife’s field marketing operations “compose the lion’s share” of its business, the suit said. The companies provide a variety of support services for independent insurance agents and brokers that enroll beneficiaries into private Medicare Advantage plans.
