HHS Fights Attempt to Block New Donated Liver Transplant Policy

The Health and Human Services Department acted well within its discretion when it adopted a new policy for determining how and where donated organs are assigned to liver transplant patients, the agency told a federal court in Georgia.

The agency is defending the policy against a challenge by transplant patients and medical centers throughout the country, who claimed the HHS’s action was arbitrary and capricious. The plaintiffs asked the U.S. District Court for the Northern District of Georgia to block the policy’s implementation.
