Drug Rebate Rule Spurs Lawsuit From Pharmacy Liaison Group (1)

A pharmacy benefit manager group is suing the HHS over a rule it says threatens its members with “significant criminal and civil liability” for negotiating drug rebates with manufacturers.

The Pharmaceutical Care Management Association on Tuesday challenged the final rule from the Department of Health and Human Services, which was released in November as an attempt to curb drug price fluctuations. The rule replaces current payment systems between manufacturers and pharmacy liaisons with fixed-fee service arrangements. It’s slated to take effect Jan. 19, one day before President-elect Joe Biden is sworn into office.
