Guidant Settles Cardiac Defibrillator FCA Whistle-Blower Lawsuit for $30 Million

The Department of Justice Oct. 17 announced it had reached a $30 million settlement with Guidant LLC, a subsidiary of Boston Scientific Corp., in a False Claims Act lawsuit involving the alleged sale of defective cardiac defibrillators to Medicare patients (United States ex rel. Allen v. Guidant LLC).

The lawsuit was filed by relator James Allen, a recipient of a defective defibrillator. The government joined Allen’s civil FCA action, and filed its own complaint in January 2011 19 HCDR, 1/28/11, 15 HFRA 121, 2/9/11. Allen’s share of the settlement as the relator was $2.25 million.
