Group of States, Nonprofits Sue Over Nursing Home Staffing Rule

Twenty state attorneys general, two nursing homes, and multiple state organizations representing nonprofit aging services providers filed suit in federal court in Iowa seeking to block and vacate the Biden administration’s rule requiring nursing homes to beef up their staffing levels.

The complaint, filed Tuesday in US District Court for the Northern District of Iowa in Cedar Rapids, claims the plaintiffs “have no option” but to “request this Court to vacate, set aside, and permanently enjoin the Final Rule.” The plaintiffs will also seek to preliminarily “enjoin the Final Rule to spare them the irreparable harm they are already ...
