Google Given Depositions With Texas in Tracking, Biometric Suits

Google LLC can depose the state of Texas to learn more about separate privacy lawsuits alleging the technology giant unlawfully tracks users’ whereabouts and search history and maintains their facial recognition data.

A procedural rule Google cited to urge the depositions “is unambiguously broad and certainly encompasses a right to depose any entity that is a party to a lawsuit,” the Texas Court of Appeals, Fifteenth District said Thursday in a written opinion.

The Austin-based panel became the first appellate court in Texas to consider whether the state must be deposed by a party it sues.
