Georgia Fertility Patient Cleared to Pursue IVF Mix-Up Lawsuit

A Georgia woman can proceed with a lawsuit alleging a South Carolina fertility practice implanted her with the wrong embryo, leading to her to lose the baby to its biological parents.

Georgia courts’ refusal to recognize a cause of action for wrongful birth and their limitations on wrongful pregnancy claims didn’t bar this atypical suit, which grew out Coastal’s embryo mix-up instead of the birth of an impaired child or a failed sterilization, the US District Court for the Southern District of Georgia said Wednesday.
