Georgia Appeals Invalidation of Six-Week Abortion Restriction

Georgia is appealing a decision that held a law barring abortions after fetal cardiac activity is detected unconstitutional, the state told a federal court.

The case now goes to the U.S. Court of Appeals for the Eleventh Circuit. Over half of the appeals court’s judges—including Andrew Brasher, who took his seat June 30—were appointed by President Donald Trump.

The law at issue prohibits abortions after about six weeks of pregnancy. It is similar to “fetal heartbeat” abortion bans enacted by a handful of other states, including Kentucky, Louisiana, Mississippi, and Ohio.
