The Fifth Circuit declined to review an order blocking Louisiana’s plan to place the Ten Commandments in every public school classroom through an initial en banc panel, rather than one containing three judges.
Fourteen judges of the US Court of Appeals for the Fifth Circuit voted against the move, according to an order Monday. Instead, three judges will hear Louisiana’s bid to vacate a Nov. 12 ruling by Judge John W. deGravelles who said the Louisiana law is unconstitutional both facially and as applied.
