The US defeated a former service member’s claim that a Veterans Affairs Department medical center in Virginia improperly released private health-care information to the state’s motor vehicle department.
Kennith Harvey couldn’t maintain a private lawsuit for the VA’s allegedly unlawful disclosure of his medical records because Virginia law doesn’t provide a right to do so, the US District Court for the Eastern District of Virginia said. The court dismissed Harvey’s Federal Tort Claims Act suit against the federal government.
