Forest Laboratories Settles False Claims Case for $38M

Forest Laboratories Inc. and a subsidiary will pay $38 million to resolve allegations they tried to increase drug sales by providing cash and gifts while encouraging marketing the drugs’ use for nonapproved purposes United States v. Forest Pharmaceuticals, Inc., E.D. Wis., 12-cv-00366, settlement 12/15/16.

The Justice Department Dec. 15 announced the settlement, which didn’t have a determination of liability, based on an April 18, 2012 complaint developed with the assistance of Kurt Kroening, a whistle-blower who was a Forest Laboratories sales representative.
