Florida Sues Medicaid Over Children’s Health Insurance Policy

The state of Florida filed a lawsuit pushing back against a move from the Biden administration to prohibit states from disenrolling beneficiaries from the Children’s Health Insurance Program.

In a motion for preliminary injunction filed Thursday in the Middle District of Florida, the state’s Medicaid program argued that the federal Centers for Medicare & Medicaid Services overstepped its power under the Administrative Procedures Act when it issued guidance notifying states that they can no longer disenroll CHIP participants who fail to pay premiums.
