A Florida doctor lost his bid to force a hospital to release credentialing and peer review documents in a lawsuit over the loss of his clinical privileges, as the materials are immune from discovery, a state appeals court said.
South Broward Hospital District doesn’t have to turn over the documents to Dr. David M. Feldbaum because they fall squarely within the types of information protected by Florida’s peer review privilege, the Florida District Court of Appeal, Fourth District, said in an unsigned opinion.
The privilege, moreover, can’t be waived, the court said.
