A Florida hospital system complied with federal law by disclosing its emergency room fees in a price list on its website, meaning a lawsuit alleging it violated state law by failing to publish the charges was properly dismissed, the provider told a federal appeals court.
Former emergency room patient Lawrence Hauser’s claim under the Florida Deceptive and Unfair Trade Practices Act failed as a matter of law because posting the prices online brought the system within the law’s safe harbor provision, it told the U.S. Court of Appeals for the Eleventh Circuit Wednesday.
