A federal district court blocked the Biden administration from enforcing a vaccine mandate for health-care workers in Texas just hours after an appeals court allowed the rule to resume in about half the U.S.
The U.S. District Court for the Northern District of Texas on Wednesday granted a preliminary injunction on the mandate within the state, pending a trial on the merits or until further order of the court.
The decision followed an order by the U.S. Court of Appeals for the Fifth Circuit that narrowed an almost nationwide injunction to only apply to 14 states—not including Texas. A separate injunction granted by a court in Missouri covers 10 additional states.
The lawsuit filed in Texas is one of four challenges to the Centers for Medicare & Medicaid Services’ rule. The cases all question the agency’s authority to implement a vaccine mandate.
The case is Texas v. Becerra, N.D. Tex., No. 2:21-cv-00229, 12/15/21.
