The Food and Drug Administration is trying to fend off a group of states suing to block access to the widely used abortion medication mifepristone, arguing the lawsuit runs afoul of courtroom norms.
Idaho, Missouri, and Kansas’ lawsuit has “no plausible connection” to the Texas federal court in which they’ve brought their challenge, the FDA said in a Dec. 6 motion to dismiss the lawsuit. The conservative-leaning states are trying to take up a lawsuit originally brought by conservative doctors that eventually made its way to the US Supreme Court.
