The FDA appealed a judge’s decision that struck down a portion of a rule subjecting premium cigars to regulation like other tobacco products, such as e-cigarettes and hookahs.

The Food and Drug Administration appealed late Friday to the US Court of Appeals for the District of Columbia Circuit in response to Judge Amit P. Mehta’s decision that vacated the agency’s decision to include premium cigars in a rule regulating various tobacco products.
