Farmer Cites Superfund to Recover Costs to Clean Up PFAS From US

The owners of a New Mexico dairy devastated by PFAS an Air Force base released are asking a federal court to award them costs they’ve spent carrying out remediation-related activities.

Art and Renee Schaap, owners of the Highland Dairy, filed a motion for summary judgment on Wednesday asking the US District Court for the District of South Carolina to direct the US government to pay them just over $80,000 to recover money they’ve spent monitoring two PFAS designated as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), or Superfund law.
