Fainting Plasma Donor Gets New Shot at Shire Pharma, Laboratory

A woman who suffered severe injuries when she fainted during a finger prick taken in preparation for donating plasma is getting a second chance at a lawsuit against the collection laboratory, as there were questions of fact over whether its employees asked about her previous donation experiences, the Sixth Circuit said Thursday.

BioLife Plasma Services LP and its parent company, Shire Pharmaceuticals, lost on Tenley Good’s appeal from a summary judgment in their favor. The U.S. Court of Appeals for the Sixth Circuit reversed and sent the case back for further proceedings.
