A recent lawsuit between pharmacy benefit manager Express Scripts and drugmaker Kaleo Inc. suggests that fixing the drug-pricing system will take more than just eliminating drug rebates.
Express Scripts claimed in the lawsuit that Kaleo had shorted it on $14.5 million in rebate payments related to Evzio, the drugmaker’s life-saving auto-injector that delivers the opioid overdose cure naloxone. Kaleo responded that it had made all payments that were due due, and had in fact been overcharged by Express Scripts by about $5 million.
