Express Scripts, Compounding Pharmacy Settle Conspiracy Claims

Express Scripts Inc. has settled claims it allegedly conspired with other large pharmacy benefit managers to put independent compounding pharmacies out of business.

ESI and HM Compounding Services LLC told the U.S. District Court for the Eastern District of Missouri that they had resolved the case Nov. 13. The announcement came as trial was about to begin.

The settlement ended HM’s claims that ESI violated federal antitrust law by entering into a boycott conspiracy with other PBMs—including CVS Caremark Corp., a subsidiary of CVS Health Corp., and OptumRx Inc, a subsidiary of UnitedHealth Group Inc.—to terminate compounding pharmacies’ provider agreements. ...
