Expert’s Suit Continues Against Law Firm, Medical Group Over Suspension for Testimony

A physician, suspended from a professional organization after he testified as an expert against another physician in a medical malpractice action, may continue his suit against the American Association of Orthopaedic Surgeons and the law firm that allegedly misrepresented his findings, a federal court in Pennsylvania ruled Nov. 8 (Graboff v. Colleran Firm).

The U.S. District Court for the Eastern District of Pennsylvania rejected a motion to dismiss the suit by the Colleran Firm—the law firm defendant that hired Dr. Steven Graboff as an expert witness—and the AAOS.
