Ex-Permanente Group Employee Wins Disability Bias, Firing Trial

Medical provider NW Permanente failed to accommodate and discriminated against a former programs coordinator because she was disabled or regarded as disabled, an Oregon federal jury found.

Angela Schultz also proved her use of leave under the Family and Medical Leave Act was a factor in the decision to fire her, in violation of the FMLA and state public policy, the jury found in a verdict entered Monday. Also, the company retaliated against her for seeking or using disability-related accommodations, the U.S. District Court for the District of Oregon jury determined.
