Eli Lilly, AstraZeneca Named in Suit for HHS Drug Discounts (2)

Three HIV/AIDS clinics are suing the HHS to compel drug companies Eli Lilly and Co., Sanofi-Aventis US LLC, AstraZeneca PLC, and Novartis Pharmaceuticals to refund what they claim are overpayments for certain drugs.

The plaintiffs say the drugmakers have cut off certain pharmacies from marked down products and put at risk vulnerable low-income patients living with HIV/AIDS.

The federal discount program called 340B requires drug companies to offer steep discounts to hospitals with primarily low-income patients and their associated pharmacies. The drug companies’ efforts to rein in 340B offer the courts a chance to clarify the reach of that program...
