Elevance Seeks Quick End to Medicare Rating Suit Against HHS

Elevance Health Inc. moved for summary judgment in its suit against the HHS claiming the insurer could miss out on $375 million in 2026 due to the department’s flawed Medicare Advantage “star ratings” calculations for 2025.

The motion was filed Feb. 14 in the US District Court for the Northern District of Texas. That’s where Elevance filed suit in October 2024, claiming the Centers for Medicare & Medicaid Services violated its own regulations and the Administrative Procedure Act, and acted in an “arbitrary and capricious” manner by failing to give the insurer a four-star rating for 2025.
