California-based vape company Huff and Puffers claims it will suffer irreparable harm if a federal court doesn’t issue a preliminary injunction against an FDA-issued civil money penalty of $20,678 levied against its business.
The company on Tuesday escalated its legal battle against the Food and Drug Administration’s civil money penalty, filing a motion for summary judgment and preliminary injunction before the US District Court for the Central District of California.
The motions come after Huff and Puffers in September sued the FDA for issuing an administrative civil money penalty, alleging the store sold an “adulterated” and “misbranded” tobacco product.
