Drugmakers See Setback in Challenge to Nebraska Pharmacy Law

A federal judge rebuffed an attempt by drugmakers to block Nebraska from enforcing a state law that could prevent manufacturers from receiving data needed to participate in a federal drug rebate pilot program.

Judge Susan Bazis of the US District Court for the District of Nebraska on Dec. 19 denied requests from the Pharmaceutical Research and Manufacturers of America, AbbVie, and AbbVie subsidiaries that sought to block a key provision of Nebraska’s 340B Contract Pharmacy Protection Act from going into effect while their lawsuits against the law proceed.
