A Mississippi statute mandating manufacturers provide discounted drugs to an unlimited number of contract pharmacies in a federal drug program is unlawful, according to a leading pharmaceutical trade association.
Mississippi’s recently enacted statute (H.B.728) outlawing any effort to deny, restrict, or prohibit drug discounts to pharmacies that contract with providers in the federal 340B Drug Pricing Program is preempted by federal law and unconstitutionally vague, the Pharmaceutical Research and Manufacturers of America wrote Thursday in a complaint before the US District Court for the Southern District of Mississippi.
