A two-step hiring process Dolgencorp LLC uses at its Bessemer, Ala., facility violates the rights of workers with actual or perceived disabilities and illegally probes private family medical history, the federal government said (EEOC v. Dolgencorp, LLC, N.D. Ala., No. 2:17-cv-01649, complaint filed 9/25/17).
The lawsuit continues the Equal Employment Opportunity Commission’s crackdown on post-offer medical examinations the agency believes are unlawful. The agency also has worked to stop forced disclosures of confidential employee medical and genetic data.
