Key provisions of the government’s regulation that established how payments should be determined in disputes between health insurers and out-of-network providers were overturned Thursday by a federal judge.
Judge Jeremy Kernodle of the US District Court for the Eastern District of Texas granted in part motions by a group of Texas doctors and other plaintiffs for summary judgment and denied in part a cross-motion for summary judgment by the Departments of Health and Human Services, Labor, and the Treasury.
