Doctors’ Gender-Affirming Care Suit Properly Dismissed, HHS Says

Christian medical doctor groups lacked the ability to sue the federal government over a directive precluding discrimination against transgender people, Health and Human Services Secretary Xavier Becerra said.

A federal trial court in Tennessee properly dismissed the American College of Pediatricians and the Catholic Medical Association’s suit for lack of standing, Becerra said Wednesday in a filing in the US Court of Appeals for the Sixth Circuit. The plaintiffs had asked the court to block HHS from enforcing Section 1557 of the Affordable Care Act against medical professionals who refuse, based on their religious beliefs, to provide gender-affirming care.
