An appeal from an injunction barring FDA’s in-person dispensing requirement for a pill used to end pregnancies must be dismissed as moot because the agencysaid it will use “enforcement discretion” during the Covid-19 public health emergency, the parties told the Fourth Circuit.
The suit from which the appeal originated has been dismissed and the injunction against enforcement dissolved, women’s health-care providers, the U.S. Food and Drug Administration, and several states said in a joint motion to the U.S. Court of Appeals for the Fourth Circuit Monday.
