Doctors Fail to Advance Suit Over Continuing Education DEI Rule

California’s medical board can validly require continuing medical education providers include information about implicit bias in their presentations.

The board controls the presentations and written materials from beginning to end, making CME materials government speech that isn’t subject to the First Amendment, the US Court of Appeals for the Ninth Circuit said Friday.

This case arose prior to President Donald Trump’s campaign to do away with diversity, equity, and inclusion initiatives in all walks of life, but reflects conservative views.
