A False Claims Act whistleblower accusing allergy treatment center operator United Biologics LLC of defrauding Medicare and Medicaid failed to adequately raise claims against physicians and medical practices that contracted with the company, a Georgia federal court said.
Terri Nix’s complaint “does little more than hazard a guess” that they submitted false claims because they worked with United Biologics, Judge Leigh Martin May of the U.S. District Court for the Northern District of Georgia said granting their motion to dismiss.
Nix also failed to show that these unrelated defendants are part of a uniform, nationwide fraud scheme, the court said. ...
