Doctor Loses Appeal Over Recommended Denial of Privileges

A California hospital beat a doctor’s claim that it violated state law by denying his application for privileges in retaliation for complaining about a patient’s treatment at another hospital, under a ruling from a state appeals court.

Mercy Hospital and its medical executive committee are separate legal entities, and William Bichai’s complaint for retaliation, conspiracy, and unfair competition under California law didn’t allege any wrongdoing by the hospital, the California Court of Appeal, Fifth District said. He alleged wrongful conduct by the hospital’s medical executive committee.

Bichai held privileges at Dignity Health’s Mercy Hospital in Bakersfield from 2008 to 2012. ...
