Medicare-eligible diabetics are demanding federal health-care payers stop denying payment for continuous glucose monitors.
People for whom CGM devices provide the only practical means of monitoring their diabetes sued Health and Human Services Secretary Alex Azar in the U.S. District Court for the District of Columbia Dec. 13.
HHS’s denials of coverage, without explanation, run afoul of the plain meaning of the Medicare statute and HHS regulations, the plaintiffs said. Multiple courts and Medicare administrative law judges have told HHS the denials are wrong, they added.
