A federal appellate panel in the nation’s capital Friday dismissed an appeal of a lower court decision that denied class certification to plaintiffs in the suit against the HHS.
Carol Lewis and Douglas Sargent, who are both diabetic and Medicare beneficiaries, had sued the Department of Health and Human Services in the US District Court for the District of Columbia seeking reimbursement for the costs of continuous glucose monitors and other supplies from 2015 to 2017.
