Montana’s highest court said a professional organization’s restraint-of-trade action against the state’s dental board may proceed (Denturist Ass’n of Mont. v. State Dep’t of Labor & Indus., 2016 BL 164855, Mont., DA 15-0580, 5/24/16).
The case is part of a long-running dispute between denturists—professionals who work exclusively with patients needing removable dental prosthetics—against the Montana Board of Dentistry, which regulates the dental profession. The Denturist Association of Montana and its members have alleged that the board promulgated unlawful rules regulating denturity in order to protect dentists from competition.
