Delaware Judge Bars Ingenus From Reviving Cancer-Drug Patent

A Delaware federal judge threw out Ingenus Pharmaceuticals LLC’s lawsuit against Hetero Labs Ltd., finding the company couldn’t pursue claims over a cancer-drug patent that had already been invalidated in a separate Illinois case against another generic-drug maker.

Ingenus can’t claim Hetero’s proposed generic cyclophosphamide infringes US Patent No. 10,993,952 because it already had a fair chance to defend the patent’s validity in an Illinois case against Nexus Pharmaceuticals Inc. and lost, Judge Jennifer L. Hall said in an opinion issued Tuesday in the US District Court for the District of Delaware.
