Deaf Woman Shut Out of Bias Lawsuit Against Eye Surgery Practice

An outpatient eye surgery practice defeated a deaf women’s claim that it unlawfully discriminated against her by refusing to provide an in-person American Sign Language interpreter for her surgery.

The patient’s allegation that the practice told her that the facility where the surgery was to take place didn’t allow interpreters in its operating room suggested that the facility, not the practice, was responsible for any supposed discrimination, the US District Court for the Eastern District of Virginia said Oct. 25. Judge Michael S. Nachmanoff dismissed the patient’s claims against the practice.
