CVS Must Face Homeopathy Fraud Suit in California State Court

Four California consumers alleging CVS Pharmacy Inc. deceptively marketed homeopathic products got their lawsuit moved back to state court when a federal court said their lack of standing to seek injunctive relief deprived it of jurisdiction to hear the case.

Joyce Benton, Melissa Greco, Anthony Swetala, and Ralph Milan alleged CVS violated California consumer protection laws by marketing the products as side-effect free treatments for ailments like colds and flu that typically go away on their own. The consumers alleged there are no modern scientific tests showing that homeopathic products are effective to treat any condition.
